Introduction
These Terms and Conditions (“Agreement”) are entered into between Remote Staffing Services (“Company,” “we,” “us,” or “our”) and the user or entity (“Client” or “you”) engaging our services. By accessing and using our services, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, please do not use our services.
Service Description
Remote Staffing Services offers staffing services, which include the sourcing and placement of remote workers and staff for various industries and roles.
We make no guarantees regarding the availability of suitable candidates as the market demand is in constant flux and demand for our qualified candidates is highly competitive.
Pricing and Fees
Our fees and pricing structure, including placement fees, hourly or salary wages, termination fees, and any additional charges, are detailed in a separate pricing document or as agreed upon with the Client.
Payment for our services is subject to the terms outlined in a separate payment agreement.
Client Obligations
Clients are responsible for working closely with us to help define accurate and complete job descriptions, ensuring timely payment, and complying with all applicable laws and regulations.
Candidate Screening
We undertake candidate screening, including qualification assessments and background checks, to the best of our abilities. However, we do not guarantee the accuracy or completeness of candidate profiles, but take every precaution possible and extend best efforts during the recruitment, training and onboarding phases.
Confidentiality
Both parties agree to maintain the confidentiality of sensitive information, including but not limited to client data, candidate information, and proprietary information.
Contract Duration
Staffing contracts may have defined durations and terms. Options for renewal, termination, and notice periods will be stipulated in individual staffing agreements.
Payment Terms
Payment terms, including invoicing, payment methods, and due dates, will be outlined in separate payment agreements.
Late payment penalties and interest charges may apply as specified in the payment agreements.
Refund Policy
Our refund policy, if applicable, will be outlined in separate refund agreements or negotiated on a case-by-case basis.
Intellectual Property
Ownership of intellectual property developed by any placed staff during their employment will be detailed in individual staffing agreements.
Non-disclosure and non-compete agreements, if any, will be specified in separate confidentiality agreements.
Liability and Dispute Resolution
The liability of Remote Staffing Services is limited to the terms agreed upon in individual staffing agreements.
Any disputes will be resolved in accordance with the procedures specified in separate dispute resolution agreements.
Termination and Cancellation
Termination conditions and notice periods will be stipulated in individual staffing agreements.
Compliance and Regulations
Both parties agree to comply with all relevant employment laws, regulations, and industry-specific standards.
Client Reviews and Testimonials
Client reviews and testimonials may be used by Remote Staffing Services for promotional purposes unless the Client requests otherwise.
Force Majeure
In the event of force majeure or unexpected events beyond the control of either party, the contract may be suspended or terminated as specified in individual staffing agreements.
Updates to Terms and Conditions
We reserve the right to update these Terms and Conditions. Any changes will be communicated to Clients, and continued use of our services constitutes acceptance of the revised terms.
Governing Law
This Agreement is governed by and construed in accordance with the laws of Virginia. Any legal actions or disputes shall be resolved in the courts of Virginia.
Severability
If any part of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
